This Privacy Policy and Terms of Service ("Agreement") governs your access to and use of the Confirmly platform and services ("Platform", "Service", or "Confirmly"), provided by Bramlett Software LLC ("Company", "we," "us," or "our"). Confirmly is a healthcare communication platform designed to facilitate patient-practice communications and appointment management.
By accessing or using Confirmly, you agree to be bound by this Agreement. If you disagree with any part of this Agreement, you may not access or use the Platform.
When you use our Platform, we collect different types of information depending on whether you are a healthcare practice user or a patient.
For healthcare practice users, we collect information necessary to create and maintain your account, including but not limited to your account credentials, contact information, professional information, and data related to your use of two-factor authentication. We also collect information about how you use the Platform through usage data and analytics.
For patients, we maintain our commitment to collecting minimal protected health information (PHI). The information we collect from patients is limited to what is necessary to facilitate communication with healthcare practices and manage appointment requests. This includes name, phone number, and when provided, email address and appointment request details. We do not create patient accounts, and patients interact with the Platform only through specific communication channels provided to healthcare practices.
We use the information we collect for the following purposes:
For healthcare practice users, we use collected information to provide, maintain, and improve the Platform; authenticate and secure your account; communicate with you about service updates and platform functionality; provide technical and customer support; and comply with legal obligations and enforce our terms.
For patient information, we use collected data solely to facilitate communication between healthcare practices and their patients, process and manage appointment requests, ensure proper Platform functionality, and maintain compliance with applicable healthcare regulations.
We implement and maintain appropriate technical, physical, and administrative safeguards to protect the security and confidentiality of all information we process, including protected health information. All data is stored on secure servers located in the United States, and we encrypt all data both at rest and in transit.
We maintain HIPAA-compliant infrastructure and processes, including Business Associate Agreements (BAAs) with all relevant parties. Our security measures are regularly reviewed and updated to ensure ongoing protection of data.
We engage certain trusted third-party service providers to perform essential functions of our service. These service providers include Amazon Web Services (AWS) and DigitalOcean for data storage and processing. We have executed Business Associate Agreements with all third-party service providers who may have access to protected health information, ensuring they maintain the same level of security and confidentiality requirements we uphold.
We retain practice account information for as long as the account remains active or as needed to provide services. Currently, patient data is retained indefinitely, though we are developing functionality to allow practices to configure specific retention periods. We may retain certain information as required by law or for legitimate business purposes.
You have certain rights regarding your information, including the rights to:
Access your personal information maintained by us; request corrections to your personal information if it is inaccurate or incomplete; request deletion of your personal information (subject to legal requirements and legitimate business needs); opt-out of certain communications; and receive a copy of your personal information in a structured, commonly used format.
Confirmly is a healthcare communication platform that provides various features including a unified communication inbox, website chat widget, appointment request management, and two-factor authentication. We grant you a limited, non-exclusive, non-transferable license to use the Platform in accordance with this Agreement and any additional terms we may provide.
You must be at least 18 years old to use the Service. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for any activities or actions under your account. Account sharing is strictly prohibited.
As a healthcare communication platform, we comply with the Health Insurance Portability and Accountability Act (HIPAA). Users who are healthcare providers must ensure their use of the Platform complies with HIPAA and other applicable healthcare regulations. We provide appropriate technical and organizational measures to protect PHI, but users are responsible for their own HIPAA compliance.
You agree not to use the Service to:
While we strive to provide reliable service, we do not guarantee that the Service will be available at all times or without interruption. The Platform is provided "as is" and "as available." We will make reasonable efforts to provide technical support during business hours and will communicate planned maintenance in advance.
The Service is currently in BETA testing phase. When payment terms are implemented, they will be clearly communicated to users before taking effect. Unless otherwise required by law, all fees will be non-refundable.
We reserve the right to suspend or terminate your access to the Service, with or without notice, for any violation of this Agreement or for any other reason we deem appropriate. You may terminate your use of the Service at any time by discontinuing use and deactivating your account.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use or inability to use the Service.
We reserve the right to modify this Agreement at any time. We will notify users of any material changes through the Platform or via email. Your continued use of the Service after such modifications constitutes acceptance of the updated terms.
This Agreement shall be governed by and construed in accordance with the laws of the United States and the State of Texas, without regard to its conflict of law provisions.
